The Operationally Safe Coffee Machine: Important Requirements for Electrical Operational Safety

This is not about the risk of scalding, but about electrical operational safety. An operationally safe coffee machine must comply with the requirements of the Industrial Safety Ordinance (BetrSichV). This ordinance requires that all work equipment, including coffee machines, be tested for safety.

According to § 14 of the Industrial Safety Ordinance, employers must inspect work equipment before initial commissioning. § 15 also stipulates that regular inspections are required. An approved monitoring service or a “competent person” must carry out these inspections. According to § 3 Para. 3 BetrSichV, the employer decides how often and to what extent these inspections are carried out and who performs them. The decision is based on the results of the risk assessment according to the Occupational Safety and Health Act (ArbSchG), manufacturer information, and intended operating conditions.

Private Coffee Machines in the Office: Safety Required Here Too

Even private coffee machines that employees bring into the office must be safety-tested. Although they are not considered work equipment within the meaning of the BetrSichV, the employer’s risk assessment still takes them into account. These machines must also not pose a danger to employee safety. The employer must regularly ensure that these devices do not cause any hazards.

The employer is therefore responsible for checking the operational safety of private coffee machines as well. To ensure this, they must implement regular safety inspections carried out by qualified specialists.

Employer Liability and Insurer Recommendations

The employer is responsible for the safety of coffee machines in the workplace. Even if employees bring their own devices, the employer must ensure that they comply with the Industrial Safety Ordinance and do not pose a hazard to employees. Various regulations, such as BGV A 3, require regular inspections for all electrical devices in the workplace.

According to the German Insurance Association (GDV), employers should prohibit private coffee machines and other electrical devices in the workplace. Instead, suitable devices for commercial use should be provided in break rooms or central kitchen areas.
